- By "website reservation," the parties understand a service agreement in which the Contractor undertakes to provide the Ordering Party with a room along with the attractions included in the package program at Zalesie Mazury Active Spa for the number of people specified in the reservation on the date specified, under the terms and conditions set forth in these regulations.
- Data of the service organizer, hereinafter referred to as the Contractor: ZALESIE MAZURY Mariusz Czeszejko-Sochacki Spółka Komandytowa Zalesie 12, 11-010 Barczewo, NIP: 7393617378, REGON: 280205080, KRS: 0001038546.
- The Ordering Party is the entity that, by making a reservation, accepts the terms of these regulations and enters into the service agreement referred to in point 1.
- The Ordering Party may submit a reservation request by telephone, e-mail, or by filling out the form on the website www.zalesiemazury.pl.
- Upon receiving a reservation request, the Contractor will provide preliminary confirmation of the reservation via e-mail, informing the client of the assigned reservation number. Until the Ordering Party receives confirmation of the reservation, the reservation is considered not made.
- During the reservation process, the Ordering Party should provide the details for the invoice to be issued for the reserved stay. If the Ordering Party does not provide additional details for the invoice, it will be issued to the details of the person making the reservation.
- The Ordering Party is obliged to pay a down payment (earnest money) in the amount of 30% of the contract value within 3 working days from the date of receiving the confirmation referred to in point 5. In exceptional cases, the Contractor may set a shorter deadline for the down payment, which will be specified in the reservation confirmation. Failure to pay the down payment within the specified period results in the cancellation of the reservation and bears no consequences for either party. Payment of the down payment constitutes acceptance by the Ordering Party of the terms and conditions contained in these regulations.
- In the event of reservation cancellation no later than 24 hours before the start of the hotel day on the day of arrival, the paid down payment may be used at any time until the end of the current year, following prior agreement with the reception (price conditions current for the new stay date apply). In the event of reservation cancellation less than 24 hours before the start of the hotel day on the day of arrival or failure to appear at the facility on the day of arrival, the paid down payment is forfeited.
- In the event of withdrawal by the Contractor from the performance of the subject of the contract through their own fault and without the fault of the Ordering Party, before the start of the service, the Contractor shall return the paid down payment and pay the Ordering Party a contractual penalty in the amount of the paid down payment.
- The Ordering Party is obliged to pay the price, in the amount of the contract value minus the down payment paid, at the latest on the first day of the stay during the check-in procedure. If the client has paid by bank transfer, they should present proof of the transfer no later than the day of arrival during the check-in procedure.
- An Ordering Party who holds a Loyalty Card issued by the Contractor is entitled to a 5% discount on the nominal price of the stay each time, unless the content of the package states otherwise.
- The Reception will issue the room keys to the Ordering Party only after the payment referred to in point 10 has been made. In particularly justified cases, the Contractor may agree to the payment of the price at a later date. Agreement for payment at a later date must be in writing under penalty of nullity.
- The Ordering Party's resignation from partial performance of the contract after receiving the room keys does not release the Ordering Party from the obligation to pay the entire agreed price and does not create an obligation on the part of the Contractor to return the payment made to the Ordering Party. In particularly justified cases, where the Ordering Party resigns from the performance of the contract during the stay due to circumstances beyond their control that they were unable to foresee, the price due to the Contractor may be reduced by 10%.
- Failure of the Ordering Party to appear at the facility by 07:00 on the second day of the stay constitutes their consent to cancel the reservation. In such a case, the Contractor will retain the down payment paid. Cancellation of the reservation in this case occurs automatically, and the Contractor has the right to reserve the room being the subject of the contract for another Ordering Party.
- In the case of package and special stays, the hotel day begins in accordance with the content of the given package.
- The hotel day ends at 11:00. The Ordering Party is obliged to vacate the room no later than 11:00 on the last day of the stay. In the case of stays under special offers, the Contractor may designate a different check-out time consistent with the content of the given package. Failure by the Ordering Party to vacate the room within the designated time obliges them to pay a special fee corresponding to 150% of the price for each commenced hotel day.
- In the case of purchasing a Gift, the Ordering Party is obliged to pay the full amount by:
- making a transfer to the bank account
- cash
- using any payment methods accepted on the Contractor's website
17.1 The Gift is not exchangeable for cash.17.2. The Client is not entitled to receive cash in the event of a change in the gift option (e.g., shortening the stay, changing Spa packages, etc.).
